1. Who we are and what this Policy covers

HEIR BRANDS LLC, a Delaware limited liability company, conducting business under the trade name “Original HEIR” (“we,” “us,” or “our”), owns and operates originalheir.com (“website” or “site”). This Privacy Policy (the “Policy”) explains how we collect, use, disclose, and retain personal information when you (i) visit our website, (ii) place an order, (iii) contact us, and/or (iv) use the related features described below (the foregoing subsections (i)-(iv) describing the “Services”). To the extent applicable in connection with the Services you utilize, HEIR BRANDS LLC is responsible for your personal information, including as controller where that concept applies.

Some website features are optional and may have additional notices. Third-party services that you choose to use, including payment processing or social media platforms, may process information under their own privacy policies. This Policy explains our practices; it is not a request for blanket consent to all processing. Please refer to such other privacy policies as necessary. We have no liability or responsibility whatsoever for the privacy policy (or other policies) of any other party.

2. Information we collect and its sources

Information you provide. We collect contact and order information such as your name, email address, billing and shipping addresses, phone number if provided, items purchased, and communications with customer support. If you create an account, we collect the information needed to maintain it. Payment providers process payment details; we receive transaction status and limited payment information needed to administer purchases.

Information collected through the website. Shopify and our configured tools collect device and usage information such as IP address, browser type, device identifiers, pages viewed, cart activity, referring pages, timestamps, and interactions with the Services. Cookies and similar technologies may be used as described below. The approximate location from which you used our Services may be derived from your IP address.

Information from service providers. We receive information from providers supporting payments, fraud prevention, order fulfillment, delivery, brand outreach, customer engagement and customer support, such as payment confirmations, fraud indicators, and delivery status. If you were directed to our website from a brand partner, shopping ambassador or other referral source, we may receive information that you provided to such referral source, and/or which the referral source collected from you.

HEIROSCOPE tool. If you elect to use our “Heiroscope” tool, we collect your questionnaire answers together with contact information needed to deliver your results. This information may include hair characteristics, styling habits, goals and/or concerns, and recommendations or assessments generated from your questionnaire responses. Heiroscope is not a healthcare tool, and the information collected and/or provided in connection with your use of Heiroscope do not constitute medical records.

Reviews. From time to time, we may collect reviews, ratings, photos, and the display name you choose for public submissions. Information you submit for public display may be visible to others.

Marketing and events. We may collect signup details, communication preferences, and information you provide to register for an event, promotion, or referral program.

We do not ask you to provide information that is unnecessary for the feature you are using. If required information is not provided, we may be unable to complete the order or Service that you have requested.

3. How we use information

We use personal information to: process payments and orders; arrange shipping, returns, and refunds; maintain accounts; answer questions; provide requested services; detect fraud and security threats; maintain and improve the website; keep business records; and comply with legal obligations and/or protect legal rights.

If you elect to use our automated Heiroscope tool, we use your questionnaire answers to assess cosmetic haircare needs, prepare recommendations, and deliver the results you request.

If you create an account on our site, register for an event, promotion or referral program, or otherwise submit your contact and/or other personal information to or through the site, we may use signup details and preferences to send marketing communications where permitted by law and, where required, with your consent. We may also use permitted website interaction data to measure campaigns, understand interest in products, and personalize marketing.

We and our advertising partners may use permitted identifiers, purchase or cart activity, and website usage data to measure advertising and show relevant ads, including on other websites and platforms.

4. How we disclose information

Service providers. We disclose information as needed to Shopify and providers that support payments, hosting, shipping, fulfillment, brand outreach, customer engagement, customer support, security, and other business operations.

Advertising partners. We may disclose device identifiers, website interactions, and relevant order or marketing information to advertising and measurement partners, subject to consent and opt-out requirements. Such disclosures may constitute a “sale,” “sharing,” or processing for “targeted advertising” under applicable privacy laws even when no money is exchanged. See the choices section below.

Legal and business purposes. We may disclose information where necessary to comply with applicable law or valid legal process, protect rights and safety, investigate fraud, or evaluate or complete a merger, financing, acquisition, or other business transaction, subject to applicable safeguards.

At your request. We may disclose information when you direct us to do so or provide the required permission. Public reviews and other public submissions are visible as described at submission.

5. Shopify

Our website store is hosted by Shopify. Shopify processes personal information when you browse and purchase through our store to support the Services, including checkout and related platform functions. Information may be transferred to Shopify and other providers in countries different from your own.

From time to time, we may use Shopify Network Intelligence. When Shopify Network Intelligence is in use, Shopify processes personal information from interactions with our store together with information from interactions with other merchants and Shopify to provide enhanced services, including personalization, improvements, and advertising features. Shopify is responsible for processing it carries out for these enhanced services. You can use our privacy choices below and Shopify’s privacy portal to exercise applicable rights, including withdrawal of consent or objection to Shopify’s processing.

6. Cookies and similar technologies

We use cookies and similar technologies to operate the website, remember preferences, maintain carts and checkout, and support security. We may also use analytics and advertising technologies to understand website usage, measure campaigns, and personalize advertising.

You can also change browser settings, although blocking necessary cookies may affect website functionality. Rejecting optional tracking does not prevent you from purchasing.

7. Your privacy choices and rights

Email marketing. Use the unsubscribe link in a marketing email or contact oh@originalheir.com. We may still send necessary transactional messages, such as order confirmations and replies to your requests.

SMS messages. If you enroll in text messages, use the opt-out instructions provided in those messages, including replying STOP where supported. Enrollment is voluntary and is not a condition of purchase. See [SMS PROGRAM TERMS URL] for program details.

Depending on your location and the laws applicable to us, you may have rights to access or know the personal information we hold, obtain a portable copy, correct inaccuracies, request deletion, withdraw consent, object to or restrict certain processing, or opt out of sale, sharing, or targeted advertising. Additional rights may apply to sensitive information or certain automated decisions. We will not unlawfully discriminate against you for exercising these rights.

Submit requests to oh@originalheir.com. We may need proportionate information to verify your identity or an authorized agent’s authority. We will respond within the applicable legal period. Some requests are subject to lawful exceptions, such as retaining records required for tax, fraud prevention, or legal claims. If an appeal right applies and we decline your request, appeal by email to oh@originalheir.com; we will explain the outcome and any available regulatory complaint options.

8. Heiroscope questionnaire information

Heiroscope submissions are handled separately from public reviews. They are used to provide your requested automated assessment and related support. We retain questionnaire answers and results until you specifically request us to delete them, subject to legal requirements.

9. Retention and security

We retain personal information for as long as reasonably necessary for the purposes described here, taking into account the type of information, the requested service, legal recordkeeping obligations, fraud prevention needs, and potential disputes.

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No internet transmission or storage system can be guaranteed completely secure. Contact oh@originalheir.com if you have concerns about information associated with your account.

10. Children

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact oh@originalheir.com so we can investigate and take appropriate action.

11. International visitors

Information may be stored and processed in the United States and other countries where Shopify and our providers operate. Privacy laws in those countries may differ from those where you live. Where applicable law requires safeguards for international transfers, we use the required safeguards. Our website store ships only to addresses within the United States. Customers outside the United States may place orders for delivery to a U.S. address.

12. Changes to this Policy; Compliance

We may update this Policy as our practices or legal obligations change. We will post the updated Policy with a revised date and provide additional notice or obtain consent where required. We will not use a policy update as a substitute for consent that the law requires.

This Policy is intended to comply with all applicable laws, and to be interpreted and construed in all circumstances in a manner that results in the Policy complying with such applicable laws. To the extent that any portion of this Policy does not comply with applicable laws, such noncompliant portions and provisions shall be deemed deleted and the remainder of this Policy shall remain enforceable to the fullest extent permitted by applicable law.
